At the end of 2024, Chambers delivered a presentation examining the recent case of James Churchill -v- Merthyr Tydfil County Borough Council [2023] EWCA Civ 1416 and the court’s evolving power to order parties to engage in alternative dispute resolution (ADR). The seminar provided an analysis of the court’s reasoning, the development of its approach to ADR, and the underlying rationale behind the decision in Churchill. The seminar also explored the broader implications of the decision and how the judgment may shape future disputes and impact case management.
